In preparing for a court hearing or trial, each of the parties will be expected to prepare a family court affidavit example. This affidavit is to be sworn in front of a Commissioner of Oaths and will be considered by the Judicial Justice of the Peace or Judge in determining what Order s/he will make. Typically, a family court affidavit will include – if applicable – the following: Affidavit Excerpt Say, for example, you have been asked by the court to attend a Motion and to file an affidavit in support of your position. The application typically will be the following: Oh dear, doesn’t that sound boring and demoralizing? Yes, it does. Well, fear not because wearing the most vibrant and whimsical apron will do nothing but add to your personality when preparing your court documents.
On the surface, preparing a statement of facts supported by evidence seems like a mundane task but if you were to look at the contents, you would expect fabulous results, just like the bright colourful apron below by Jillie Willie. The facts of your case create the basis of your argument, just as the elements of fashion create the basics of the apron. You take a little this and remove a little that, mix in some spice and voila! A wishful apron! Creating a family court affidavit requires you to be as original and creative as Jillie Willies’ apron – perhaps even more. Fact: most legal documents lack pizzazz and are often boring. Fact: designing and sewing an apron also lacks pizzazz and is often boring. However, if you are able to recognize that a family court affidavit can be fashioned in a way that creatively expresses your personality, it will be a much more exciting process.
If you think it is too large a stretch to compare pancakes and seaming fabric, think of the whole process as ‘fashioning your evidence’. How is your evidence a reflection of you? Your ‘evidence’ should be honest, truthful and clear. Just like a well-fitting apron, a fashionably fitted affidavit doesn’t hinder you from moving about, it helps you.
For example: Example Does that apron sound like something that you would wear while cooking your French Toast? Yes, absolutely. Now, think of the individual who has submitted the complaint against you. Did that sound like their personality? Sure it did. In fact, the above is an excerpt from an affidavit drafted by my office in a family law litigation matter we are currently handling. That affidavit – or statement of facts – was drafted by my client in narrative form and was one of the documents that convinced the judge at trial that my client’s interpretation of the facts was believable and then – as a result – the judge ruled in my client’s favour on all issues before the court.
Just as a designer apron has many different components that, when brought together as a whole, create that signature look, your evidence must be approached in a similar fashion. For instance: Those are the important contents of a family court affidavit, however, in between the agonizing struggle to draft a useful affidavit, consider taking some advice from the sewing machine: Remember, just like fashion and seeking a positive result when you press “start” on that sewing machine, the affidavit creates a record that will be reviewed by the court. If you function correctly, adjusting your needle to best suit your needs, the result will be a well-fitted representation of your position that will lead you to achieving the result you rightfully deserve!
